The BGH ruling: Penalty interest & fees are illegal!

On February 4, 2025, the Federal Court of Justice clarified in four test cases that banks and savings banks had violated applicable law.

  • Penalty interest (custody fees) on savings balances were inadmissible from the outset. Banks have ripped off customers by charging them money for saving – even though this is against the very purpose of saving.
  • Charges for replacement bank cards and PINs are invalid. Banks have been charging fees for lost or defective cards and PINs for years – this is also illegal according to the BGH!

The verdict is in: the banks have to pay back the money! But they won’t do it automatically.
