I will now show you how the objection procedure works:
1. you have prepared and submitted the inheritance tax
The prerequisite for an appeal against the inheritance tax assessment is the submission of the inheritance tax return to the tax office.
2. you receive the inheritance tax assessment notice
Once you have submitted the declaration to the tax office, the tax office will send you the inheritance tax assessment notice. From this point, you now have one month to lodge an objection. We recommend this: The sooner, the better!
3. the model objection
You submit the sample objection to the tax assessment notice. This ensures that the assessment does not become legally binding. It also suspends the payment of inheritance tax. Please note, however, that you will still have to pay the inheritance tax at some point, but not now and not in the amount! Without the model objection, you would pay too much if the inheritance tax in its current form is classified as unconstitutional by the Federal Constitutional Court.

After you have lodged the model objection, the tax office will confirm that the proceedings have been suspended until the Federal Constitutional Court has ruled on the possible unconstitutionality.
