The Hessian Tax Court confirms the PepperPapers model case against property tax. The proceedings are suspended – pending a decision at the highest instance

The reform of property tax has been criticized throughout Germany – excessive valuations, incomprehensible calculations and unfair assessments are a burden for millions of property owners. Together with those affected, we at PepperPapers.de have therefore filed a model lawsuit against the new property tax model. Now there is good news:

  • The Hessian Tax Court has ruled that our test case will be suspended until clarification by the highest court.

What does that mean exactly?

The ruling means that the proceedings in Hesse will not be continued for the time being until either the Federal Fiscal Court (BFH) or even the Federal Constitutional Court has made a fundamental decision. This is an important stage victory!

This is because instead of having to obtain individual decisions in each federal state or at each tax court, everything is now concentrated on clarification by the highest court. This saves time and money – and prevents contradictory rulings at state level.


Why is this so important to you?

  • You don’t need to do anything else at the moment.

  • This shows that our legal arguments are taken seriously.

We are committed to ensuring that the valuation of property tax is transparent, comprehensible and, above all, affordable and constitutional. This ruling has brought us a great deal closer to this goal.


What happens now?

Now it’s up to the highest courts. Either the Federal Fiscal Court or the Federal Constitutional Court will decide whether the current valuation procedure is valid – or whether it needs to be revised. Until then, it’s a case of wait and see and keep up the pressure together.
