The court ruling from Saxony is causing a stir:
The tax court demands: Property owners should pay the new property tax now – even if it later turns out to be unconstitutional.

The reason? The municipalities need money. The fact that model lawsuits are currently being filed throughout Germany is irrelevant to the judges.

But you don’t have to accept this. If your application for a suspension is rejected, you have two strong legal remedies – without a lawyer:


1. the hearing objection

If the court has ignored your arguments, you can complain about this – legally correct with a notice of hearing(§133a of the Fiscal Court Code). You have 2 weeks from the date of notification of the decision to do this.

2. the constitutional complaint

The judgment violates your fundamental rights:

  • Property

  • Equality

  • Right to a fair trial

You can defend yourself against this with a constitutional complaint to Karlsruhe (Section 90 of the Federal Constitutional Court Act). And the best thing is: the complaint to the court is free of charge!
You have 1 month to do this.
