With this legal document you inform your customers about their right to revoke the service contract. Consumers have this right for all contracts and orders that are not made in person at your company.
For example, your customer ordered by phone or mail, or you got the order when you met, in your apartment, house or other place.
Your customer can therefore revoke all contracts and orders and get his money back. It does not matter whether you have already performed the service. For example, you have installed the kitchen, repaired the roof, installed or serviced the heating system. Or you have advised, treated or coached your customer. The customer may keep all of this in any case and does not have to pay for it if you have not informed him about his right of withdrawal.
This was decided by the European Court of Justice in its new ruling. The Court puts consumer protection above everything else in first place. Consumer protection also includes the fact that you send the customer a cancellation policy. If you have not provided your customer with this information, the customer can demand that you return all the money he has paid. And the customer does not have to pay for your service. This is stated word for word in the new ruling.
It is important that you protect yourself against this in writing. You can mail it to the customer, then you don’t need to sign the legal document. You can also print it on paper and hand it over personally: In both cases, it is important that your customer signs the legal document in duplicate and returns it to you. For your legal security and – if the customer cancels the contract and demands repayment – for the legal security of your company.
